Terms of service
Terms & Conditions
Effective Date: 2 October 2026
These Terms & Conditions apply to your use of the Tako Mats website and to products and services supplied by Tako Mats.
By accessing our website, placing an order, uploading artwork or other content, or purchasing a product from us, you agree to these Terms & Conditions.
1. About Us
Tako Mats is an Australian-owned business based in Sydney, New South Wales. We design, manufacture and supply custom and pre-designed gaming products, including TCG playmats, gaming mats and other customised products.
In these Terms, “Tako Mats”, “we”, “us” and “our” refer to Tako Mats, and “you” and “your” refer to the customer or website user.
2. Orders & Payment
All prices displayed on our website are in Australian dollars (AUD) and include GST where applicable.
Orders are accepted subject to payment, availability and our acceptance of the order.
We reserve the right to refuse, suspend or cancel an order where reasonably necessary, including where:
-
a product or material is unavailable;
-
incorrect pricing or product information has been displayed;
-
we suspect fraud or misuse of our services;
-
an order contains content that we reasonably believe may infringe intellectual property rights, applicable laws or these Terms;
-
there is a technical, production or equipment issue that prevents us from reasonably fulfilling the order; or
-
we are otherwise unable to manufacture or fulfil the order.
If we cancel an order before production because we are unable or unwilling to supply it, we will refund amounts paid for any product we will not supply, except where otherwise permitted by law.
Payment is processed using third-party payment providers. We do not control the operation of those providers and their own terms may also apply to your transaction.
3. Custom Products & Customer-Supplied Content
Tako Mats allows customers to create products using images, artwork, photographs, logos, graphics, text and other content supplied, uploaded or selected by the customer (Customer Content).
Your Responsibility for Customer Content
By uploading, submitting, selecting or otherwise providing Customer Content to Tako Mats, you represent and warrant that:
-
you own the Customer Content or have obtained all licences, permissions, consents and other rights necessary to use and reproduce it;
-
you have the right to authorise Tako Mats to reproduce, print, manufacture, display and otherwise use the Customer Content in accordance with these Terms;
-
our reproduction, display and use of the Customer Content for the purposes permitted under these Terms, including manufacturing your order and promoting Tako Mats' custom products and services, will not infringe any copyright, trade mark, design right, moral right, privacy right or other right of another person;
-
the Customer Content does not breach any applicable law; and
-
you are authorised to instruct us to reproduce the Customer Content.
Purchasing a custom product for personal or private use does not, by itself, mean that you have permission to reproduce copyrighted or otherwise protected material.
You are responsible for determining whether you have the necessary rights and permissions to use Customer Content.
Licence to Tako Mats
By uploading, submitting, selecting or otherwise providing Customer Content to Tako Mats, you grant Tako Mats a non-exclusive, worldwide, royalty-free licence to store, process, reproduce, modify, crop, resize and otherwise use that Customer Content as reasonably necessary to:
-
prepare proofs or previews;
-
provide image enhancement and production services;
-
manufacture and fulfil your order;
-
perform quality control;
-
provide customer support; and
-
photograph, film, display and promote products manufactured using your Customer Content for Tako Mats' portfolio, website, social media, digital advertising, email marketing and other promotional or marketing activities.
This licence includes the right for Tako Mats to photograph or film a completed custom product and publish those photographs or recordings for promotional purposes.
You acknowledge that Tako Mats may identify a product as a customer-created or custom order when displaying it publicly.
You represent and warrant that you have all rights, permissions and consents necessary to grant Tako Mats the licence described above, including permission for Tako Mats to reproduce and display the Customer Content in connection with the promotion of Tako Mats and its custom manufacturing services.
This licence does not transfer ownership of your Customer Content to Tako Mats and does not give Tako Mats the right to sell your Customer Content as a standalone design or offer it for sale to other customers unless we have separately obtained permission to do so.
Where reasonably requested, Tako Mats may agree not to publicly display a particular custom order. Any such request should be made before the order enters production.
Intellectual Property Review
Tako Mats provides custom manufacturing and printing services. We do not undertake to investigate or independently verify the ownership, copyright status, trade mark status or licensing status of every image or other item of Customer Content submitted to us.
However, we reserve the right to review, reject, suspend or cancel any order where we reasonably believe Customer Content may infringe another person's intellectual property rights, breach applicable law, breach these Terms or otherwise expose Tako Mats or another person to legal risk.
We may request evidence that you own or have permission to use particular Customer Content.
Our acceptance, processing, enhancement, proofing, manufacture or printing of Customer Content does not constitute confirmation, representation or legal advice that the Customer Content is lawful or that you have the necessary rights to use it.
Intellectual Property Claims
If a third party alleges that Customer Content supplied by you infringes their intellectual property or other rights, you agree to reasonably cooperate with Tako Mats in responding to the claim.
To the extent permitted by law, you are responsible for losses, liabilities, damages, costs or expenses reasonably incurred by Tako Mats as a direct result of a third-party claim arising from Customer Content supplied by you where you did not have the rights or permissions you represented that you had.
Nothing in this clause limits any rights or remedies that cannot lawfully be excluded under Australian law.
4. Prohibited Content
You must not submit Customer Content that:
-
you do not have the legal right or permission to reproduce or use in accordance with these Terms;
-
infringes copyright, trade marks, design rights or other intellectual property rights;
-
is unlawful;
-
promotes or depicts unlawful activity;
-
contains unlawful defamatory material;
-
unlawfully violates another person's privacy or other legal rights; or
-
is otherwise content that we reasonably consider we cannot lawfully manufacture.
We reserve the right to refuse to manufacture Customer Content falling within these categories.
5. Image Enhancement & Customer Artwork
Where available, Tako Mats may provide image enhancement, cleanup, resizing or other preparation services for customer-supplied artwork.
These services are intended to improve the suitability of an image for printing but cannot create detail that does not exist in the original source file.
Colours displayed on screens may differ from printed colours due to differences between displays, colour profiles, materials, inks and printing processes.
Unless required by the Australian Consumer Law or another applicable law, Tako Mats is not responsible for defects or limitations caused solely by:
-
low-resolution or poor-quality source artwork;
-
incorrect dimensions or aspect ratios supplied by the customer;
-
spelling, design or other errors contained in customer-supplied or customer-approved artwork;
-
inherent limitations of the source image;
-
cropping or positioning resulting from the dimensions or aspect ratio selected by the customer; or
-
reasonable differences between screen display and physical printing.
6. Proofs, Mock-ups & Customer Approval
Where we provide a digital proof, preview or mock-up for approval, you are responsible for reviewing it before approving production.
Your approval authorises us to proceed with manufacturing.
You should carefully check artwork, positioning, cropping, spelling, dimensions, orientation and other visible elements before approving a proof.
If the final product accurately reflects a proof that you approved, we are generally not required to remake the product because you subsequently change your mind about the approved design.
If you request changes after approving a proof or after production has commenced, additional charges may apply and we may be unable to make the requested changes.
Nothing in this section affects any rights you have under the Australian Consumer Law.
7. Production, Shipping & Delivery
Production Times
Tako Mats products are manufactured to order.
Any production, completion, dispatch or delivery timeframe displayed on our website or otherwise provided to you is an estimate only and is not a guaranteed completion, dispatch or delivery date.
Production times may vary depending on:
-
order volume;
-
seasonal demand;
-
product and material availability;
-
equipment availability;
-
artwork requirements;
-
production complexity;
-
staffing;
-
technical or equipment issues; and
-
other operational circumstances.
During periods of high demand, orders may be subject to production delays or backlogs.
We reserve the right to extend estimated production times where reasonably necessary to complete orders.
We endeavour to keep customers informed where we become aware of a significant delay to their order. However, a delay beyond an estimated production or dispatch timeframe does not automatically mean that an order has been cancelled or that a custom product is eligible for a refund.
If you require an order by a particular date, you should contact us before ordering.
Unless Tako Mats expressly agrees in writing to a specific deadline, we do not guarantee that an order will be produced, dispatched or delivered by a particular date.
Shipping & Delivery
Orders are shipped using Australia Post, unless we advise you otherwise.
Shipping options such as Express Post relate to the Australia Post delivery service selected for the order.
Express shipping does not mean express production and does not reduce the time required for us to manufacture your custom order unless expressly stated otherwise.
Any Australia Post delivery timeframe displayed or communicated by Tako Mats is an estimate only and is not a guaranteed delivery date.
Once an order has been dispatched, delivery is handled by Australia Post and may be affected by delays or circumstances outside our reasonable control.
Tracking information will be provided where available.
You are responsible for providing an accurate and complete delivery address. Additional costs resulting from an incorrect or incomplete address supplied by you may be payable by you.
Nothing in this section excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
8. Returns, Refunds & Custom Products
We do not offer refunds or exchanges solely for change of mind unless we choose to do so.
Because custom products are manufactured specifically for you, we generally cannot accept a return or cancellation simply because you no longer want the product, provided the product supplied matches your order and is not faulty.
Once production of a custom product has commenced, we may be unable to cancel or modify the order.
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
If a product has a major problem, is faulty, is not of acceptable quality, does not match its description or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy under Australian law.
If you believe there is a problem with your order, contact taco@takomats.com.au with your order number, a description of the issue and, where practical, photographs showing the problem.
We ask that problems be reported as soon as reasonably practicable after they are discovered so that we can investigate and resolve the issue.
9. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights provided by the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These rights apply in addition to any warranty voluntarily offered by Tako Mats.
10. Tako Mats 2-Year Warranty
In addition to your rights under the Australian Consumer Law, Tako Mats provides a 2-year warranty against manufacturing defects on eligible Tako Mats products.
Depending on the product, manufacturing defects may include:
-
delamination or separation;
-
manufacturing-related print defects;
-
abnormal or significant fading under normal use;
-
defective stitching; or
-
faults in materials or manufacture.
The Tako Mats warranty does not cover:
-
normal wear and tear;
-
accidental damage;
-
misuse or abuse;
-
inappropriate storage;
-
damage caused by improper cleaning or chemicals;
-
damage caused by excessive heat, moisture or other inappropriate conditions;
-
alterations made after delivery; or
-
problems caused solely by customer-supplied artwork.
The expiry of our 2-year warranty does not necessarily mean that your rights under the Australian Consumer Law have expired.
To make a warranty claim, contact taco@takomats.com.au with your order number, details of the problem and, where practical, clear photographs showing the issue.
11. Tako Mats Intellectual Property
Unless otherwise stated, the Tako Mats name, logos, branding, website content, product photography, graphics and original designs created by Tako Mats are owned by or licensed to Tako Mats.
Artwork sold through our artist programs, collaborations or licensed collections may remain the intellectual property of the relevant artist or rights holder and is used by Tako Mats under licence.
You may not reproduce, distribute, commercially exploit or otherwise use Tako Mats content or licensed artist content except with the permission of the relevant rights holder or as otherwise permitted by law.
Purchasing a product does not transfer copyright or other intellectual property rights in the artwork printed on that product.
12. Intellectual Property Complaints
Tako Mats respects the intellectual property rights of creators and rights holders.
If you believe that material submitted to or reproduced by Tako Mats infringes intellectual property rights that you own or represent, please contact:
Please provide sufficient information for us to identify the relevant material, details of the rights you claim, your contact information and any supporting information reasonably necessary for us to assess the complaint.
We may suspend production, remove content, cease displaying promotional material, cancel an order or take other reasonable action while investigating an intellectual property complaint.
Where appropriate, we may contact the customer who supplied the relevant Customer Content and request evidence of their right to use it.
13. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
Subject to those rights and to the fullest extent permitted by law, Tako Mats is not liable for indirect or consequential loss arising from circumstances outside our reasonable control.
We are not responsible for loss resulting solely from information, instructions, artwork, files, measurements, addresses or other materials incorrectly supplied by you.
Any limitation or exclusion contained in these Terms applies only to the extent permitted by applicable law.
14. Privacy
We collect, use and handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws.
Customer Content may be stored and processed as reasonably necessary to manufacture products, provide customer service, maintain appropriate business records, promote our products as permitted under these Terms and operate our services.
15. Changes to These Terms
We may update these Terms from time to time.
The Terms applying to an order will generally be the Terms in effect when the order is placed, unless a change is required by law.
Updates to these Terms will be published on our website with an updated effective date.
16. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary to make it valid and enforceable.
If it cannot reasonably be read down, it will be severed from these Terms.
The remaining provisions will continue to apply.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Subject to any rights you may have under applicable consumer law, disputes relating to these Terms or an order are subject to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.
